Terms and Conditions 

Copyright and Ownership of  Materials

·      The Copyright Designs and Patents Acts assign the copyright of the images to the Photographer. It is therefore contrary to the Acts, and illegal, to copy, or allow to be copied, by any means photographic, by computer, or internet or otherwise, by any person or machine other than as set out in this Agreement.

·      Copyright is automatically assigned to the Photographer, but the Photographeragrees to license the Client the use of the images for personal use and theirsocial media with credit to the photographer as stated below.

·      While the Photographer agrees to license the use of the images to the Client,the Client does not have the right to sell the images for commercial purposeswithout the Photographer’s permission.

    ·       If the Client wishes to use any of the Photographer’s images from the shoot on any third-party social media platform or published digitally or in print in any third-party publication including magazines and newspapers the Client must inform the Photographer beforehand and credit the use of the images.

·      If the Client does publish any of the images in any third-party publication including magazine and newspapers the Client must credit the Photographer asPhoto by Amelia Allen. Whenever possible on social media the Photographer requires the Client to credit the Photographer by using@ameliaallenphotography(Instagram).

·       If the client receives an offer of paid advertising promotion for the use of the images in any magazine, newspaper, online platform, or brochure they shall inform the Photographer who will be paid for this usage of their images.

Payment Terms  and  Payment

·     Payment terms are strictly 30 days from the date of the relevant invoice (“theDue Date”) unless agreed in advance and in writing;

·     The Photographer reserves the right to charge interest at the rate prescribed by the Late Payment Of Commercial Debts (Interest) Act 1998 from the due date until the date payment is made.

·     The photographer issues a deposit invoice prior to booking a shoot which coversthe time of the shoot. The photographer will not hand over final images until apayment has been made. If a same day edit on the day of the shoot is required,then payment must be received up front.

Archiving of Images

·     All final images will be stored and archived by The Photographer for 1year.  If archived photographs are required after that time or additionalstorage time is required an admin. fee may be charged. 

·     If The Photographer loses images stored in archive or they are stolen, The Photographer is not liable beyond 1 year of storage.  Within 1 year, ThePhotographer is liable to the cost of the originals (a return of the original fee).

·       Once the Photographer hands over the digital images to the Client it is the Client’s responsibility to save and back up the images on a safe hard drive.The Photographer is only able to resend the images once if the Client does not download the link to the images within the time window provided.

·       Backup and storage of photos: The photographer advises clients to back up their photos to several hard drives immediately after receiving them. The photographer is not responsible for keeping copies of the Client’s photos after delivery; however, the photographer does keep master backups o fall the files for up to 6 months after a shoot.

Charges, Timings and  Deliverables

·       If The Photographer provides a quote to The Client, the fee will be charged atthat agreed rate. The Photographer generally requests a brief at the time ofbooking (via email or verbally). 

·       Where extra expenses or time are incurred or needed by the Photographer as aresult of alterations to the original brief by the Client or otherwise at theirrequest, the Photographer will reserve the right to charge the Client extraexpenses and fees.

·       If The Client changes the length of the job, the fee will increase as per theagreed hourly rate. If The Client is delayed or running late and the job runsinto extra time again the fee will increase as per the agreed hourlyrate.  The Photographer will make The Client aware of timings and shouldthe work run into extra time he will make the client aware of this and theassociated costs.  There is a mutual understanding between The Client andThe Photographer that punctuality is important and respected by all parties.

·       If it becomes apparent when the job starts that it is much bigger or differentjob to the agreed brief it will be made clear to the Client that ThePhotographer’s fee may increase. If the Photographer is unable to contact theclient/payer of invoice at that time work will stop until contact has beenmade.

·       On the occasion that incorrect information is given by the Client regarding abooking (wrong location, wrong time etc.) or the Client fails to arrive at theagreed location/time, the full fee will be charged to the Client.

·       If on arrival at a booked job there is an issue (outside of the Client orPhotographer’s control) such as bad lighting or restrictions are in use ofwhere the shoot is taking place, a fee may be charged to cover time.

·       Any congestion charges, road toll charges and parking costs will be billed tothe client as a Photographer expense and will be added onto the invoice.

·       The Photographer will spend the agreed number of hours on standardpostproduction retouching and on the agreed number of images but if additionalhours or images are required the Photographer will invoice the Client forthis. 

·        Please note that any alterations made to the booking by the Client once details have been confirmed may only be made at the discretion of thePhotographer and in some circumstances (such as the change of date or time) the Photographer may be unable to accommodate these alterations due to a conflict of commitments. Under these circumstances the Photographer is not liable to compensate the Client in any way whatsoever. The deposit is non-refundable.

   ·      The Client and the Photographer will agree on a number of images to be edited and handed over to the Client post shoot.Should the client like to purchase additional images from the shoot then this should be discussed, and the photographer can quote the client for this additional charge and work.

     ·      The Photographer will spend the agreed number of hours on standard post production retouching and on the agreed number of images but if additional hours or images are required the Photographer will invoice the Client for this.

     ·     For standard portrait shoots the photographer will send the images low res within a few days of the shoot for the client to then select the agreed images they would like retouched and high res. If the client does not send back their selects within a timely manner then the photographer will not be able to work on these. This can mean the photographer goes into a busy period of work and will be retouching other clients images so the client will have to wait until the next available retouching date. The photographer recommends returning the images you would like retouched within2weeks to ensure you get the images as soon as possible.

      ·     If the client would like a same day edit thismust be discussed with the photographer at the booking stage so thephotographer has prior warning and can allocate the time to turn around theimages.

·        The Photographer will shoot all images in RAW and will not hand over RAWfiles to the Client. The images will be handed over in high res JPEG format.
